  1. Eligibility
    1. 1.1. NewsMachine’s General Terms and Conditions, Terms of Use for PressMachine and Terms of Use for NewsMachine Newsletter are included as part of the agreement entered into for the Service. To use the NewsMachine Newsletter, you must therefore accept the terms of these documents.
    2. 1.2. By using the NewsMachine Newsletter, you warrant that you understand the contents of the Terms and Conditions, the PressMachine Terms of Service and this NewsMachine Newsletter policy document. You also warrant that you will not use the NewsMachine Newsletter in a manner that violates any laws or regulations.
    3. 1.3. NewsMachine reserves the right to close the account of a user who uses the Service in violation of the terms set forth in these documents.2
  2. 2. Changes
    1. 2.1. NewsMachine reserves the right to change these terms by publishing the updated terms of use on our website (www.newsmachine.com) and / or by sending an email to the email address you provided.
  3. 3. Account and password
    1. 3.1. You are responsible for keeping your account name and password secret. You must immediately notify us if any unauthorized person has used one of your accounts. We are not responsible for any losses due to stolen or hacked passwords. We do not have access to your current password and for security reasons we can only reset your password to a new one.
  4. 4. Rules and abuse – general rules
    1. 4.1.1. The mailings must not violate any NewsMachine’s rules for acceptable use, which are part of these terms of use.
    2. 4.1.2. If you violate any of these rules, NewsMachine has the right to suspend or terminate your account. No refund of already invoiced amounts will be made if this occurs as a result of you violating NewsMachine’s rules for acceptable use.
  5. 5. Responsibility
    1. 5.1. Limitation of liability
      1. 5.1.1. NewsMachine is not responsible for any indirect, special or consequential damages resulting from the use of the NewsMachine Newsletter.
      2. 5.1.2. NewsMachine provides the Service in its existing condition.
  6. Acceptable use
    1. 6.1. The service is only intended to send relevant information. Therefore, make sure that the content of your mailing is relevant and in demand for your specific recipients. NewsMachine Newsletter is for opinion formation, information and similar messages – not for so-called spam. The service is not intended to send messages with offers or for other commercial purposes, except to recipients who have actively chosen to subscribe to your newsletter.
    2. 6.2. NewsMachine has the right to assess what is to be described as relevant information.
    3. 6.3. Prohibited content
      1. 6.3.1. You may not use the NewsMachine Newsletter to send something offensive, or anything that promotes anything illegal or harms anyone. You may not send:
        a) Pornography or other sexually explicit mail.
        b) Emails offering to sell illegal goods or services.
    4. 6.4. Prohibited measures
      1. 6.4.1. It is not allowed to send spam, ie unwanted mass mailings.
      2. 6.4.2. It is not permitted to use purchased, rented or third-party lists with e-mail addresses.
      3. 6.4.3. It is not permitted to use in newsletters materials that have not been created by you, given to you to use, or that would infringe on anyone’s rights. This includes text, images, graphics and other content.
      4. 6.4.4. You may not use misleading subject lines or other misleading information when using the NewsMachine Newsletter.
      5. 6.4.5. You may not disseminate your login information to the NewsMachine Newsletter.
      6. 6.4.6. It is not permitted to use the Service for the purpose of creating a competing product.
      7. 6.4.7. It is not permitted to try to hide the deregistration link or otherwise prevent deregistration of contacts.
      8. 6.4.8. It is forbidden to use “dirty” lists. This refers to lists that generate a large amount of hard bounces. A large amount is in this respect if the bounces exceed 2% of the total number of recipients in the mailing. A distinction is made between soft and hard bounces. Soft bounce means that the message is recognized on the recipient’s e-mail server, but does not reach the inbox. This could be because the inbox is full, the server is overloaded or something else is temporarily wrong. Hard bounces mean that your letter is not possible to deliver, and may be due to the e-mail address being invalid, misspelled. That the e-mail address has expired or similar. Addresses that generate hard bounces need to be cleared as soon as possible.
  7. 7. Prohibited email addresses
    1. 7.1. According to the Data Protection Ordinance, you must obtain consent if you want to send newsletters to private individuals or individual companies. By using the Service, you guarantee that you have obtained consent in cases where mailings are made to these recipients.
    2. 7.2. NewsMachine has the right to restrict the ability to import addresses from domains that are primarily used for private use.
  8. 8. Your contact lists
    1. 8.1. Your contact lists are stored on a secure server. We will not, under any circumstances, sell your lists, contact people on your list, send advertisements to your lists, steal your lists, or share your lists with any other party, unless required by law.

  9. 9. Disclaimer and Force Majeure
    1. 9.1. NewsMachine can not be held responsible for the behavior, opinions or actions of users and their content.
    2. NewsMachine is not responsible for any delays or errors in the performance of any part of the Service for reasons that are not under our control.
    3. 9.2. This includes, but is not limited to, changes in laws or regulations, embargoes, fires, earthquakes, floods, strikes, power outages, unusually severe weather conditions, and the actions of hackers or third-party Internet service providers.
